1. Acceptance of Terms

1.1 Agreement to Terms

7.2 User-Initiated Account Closure

Before account closure is processed, all pending bets must be settled, all outstanding wagering requirements must be cleared, and all withdrawable funds must be withdrawn. pbwin reserves the right to retain account records for compliance and legal purposes following closure.

7.3 Forfeiture of Funds

8. Limitation of Liability

8.3 Maximum Liability

To the fullest extent permitted by Philippine law, pbwin's total liability to any User for any claim arising out of or related to the use of the platform shall not exceed the total amount deposited by that User in the twelve (12) months preceding the claim.

8.4 Exclusion of Consequential Damages

In no event shall pbwin be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, or loss of goodwill, arising out of or in connection with your use of the pbwin platform, even if pbwin has been advised of the possibility of such damages.

9. Intellectual Property

All content on the pbwin platform — including but not limited to the pbwin name, logo, website design, graphics, text, software, game interfaces, and promotional materials — is the exclusive property of pbwin or its licensors and is protected by applicable Philippine and international intellectual property laws.

9.2 Restricted Use

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the pbwin platform solely for personal, non-commercial gaming purposes in accordance with these Terms. You may not copy, reproduce, distribute, modify, create derivative works of, publicly display, or exploit any pbwin content without prior written permission from pbwin.

9.3 User-Submitted Content

Any violation of these prohibitions may result in immediate account termination, forfeiture of funds, and referral to Philippine law enforcement authorities where appropriate.

12. Governing Law & Dispute Resolution

12.1 Governing Law

These Terms & Conditions shall be governed by and construed in accordance with the laws of the Republic of the Philippines. Any dispute arising from your use of the pbwin platform shall be subject to the exclusive jurisdiction of the competent courts of the Republic of the Philippines.

13. Miscellaneous Provisions

13.2 Entire Agreement

These Terms & Conditions, together with the pbwin Privacy Policy and Responsible Gaming Policy, constitute the entire agreement between you and pbwin with respect to your use of the platform and supersede all prior and contemporaneous understandings, agreements, representations, and warranties relating to the subject matter.

13.3 No Waiver

pbwin's failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver of a specific breach shall not be construed as a waiver of any subsequent breach of the same or any other provision.

13.4 Language

These Terms & Conditions are written in English. In the event of any conflict between an English version and any translated version of these Terms, the English version shall prevail.
